1. Who we are
These terms are between you (“the client”) and Blackpool Web Design (“we”, “us”), of Blackpool Enterprise Centre, Lytham Road, Blackpool, Lancashire FY4 1EW. By signing up online or instructing us to begin work, you agree to these terms.
2. What's included
The monthly service includes: design and build of your website, UK hosting, an SSL certificate, one domain name, business email, ongoing content edits, local-SEO set-up and support. Anything outside this - additional websites, bespoke development, paid advertising, printed materials - is quoted separately.
3. Fees & payment
- A one-off setup fee of £99 is payable at sign-up, alongside your first monthly payment.
- The service then costs £29.99 per month (plus any add-ons you choose), taken automatically by recurring card payment. Billing starts on day one of sign-up - your monthly fee pays for the web space and hosted services your site is built on, which we set up straight away.
- A free .co.uk domain is included with your initial sign-up. If you'd like a different extension (e.g. .com), any difference is quoted first.
- Domain renewals after the first year are billed to you annually at the standard renewal rate, separate from your monthly fee.
- Card details are captured and stored securely by our payment processor, Stripe. We never store full card numbers ourselves.
- Prices include VAT where applicable. We may review and adjust our prices, normally no more than once a year, giving at least 30 days' written notice; your rate won't change during a build.
4. Failed payments
If a monthly payment fails, we'll automatically retry and let you know by email/WhatsApp. If payment remains unpaid after 14 days, we may suspend the website until the account is brought up to date. We'll always try to reach you first - suspension is a last resort, not a surprise.
5. Your content
You confirm you own, or have permission to use, all text, images and logos you give us, and that they don't break any law or third-party rights. You keep ownership of your own content at all times. We may show your finished website in our portfolio unless you ask us not to.
6. Domains
- A free .co.uk domain is included with your initial sign-up and registered through our registrar (ENOM) as part of your service.
- Renewals after the first year are billed to you annually at the standard renewal rate. We'll remind you before each renewal.
- For .uk transfers, the move is completed by changing the domain's IPS tag to our registrar - no authorisation code is required.
- For .com and other domains, we'll ask you for the transfer/authorisation (EPP) code and unlock the domain.
- You may prefer to keep an existing domain with your current provider - that's fine; we'll point it to us using DNS.
- Domain ownership follows section 10: within your first 12 months the domain is held by us as part of the service; once you've completed 12 months it is transferred to you on request.
7. The website & our work
We aim to show you a first design within about a week of receiving your brief, and to refine it with you over up to three rounds of revisions; further changes are handled as normal content edits once you're live, or quoted separately if substantial. We aim to have your site live within 7 days as standard, once you've supplied everything we need. We don't start the design until your content is with us - so if we're waiting on your text, photos or logo, the clock pauses and delivery moves back to match. If you add our copywriting, we can usually start (and finish) sooner. More involved builds - online shops, large sites or bespoke features - can take longer, and we'll give you a timescale up front. Timescales are estimates and depend on you supplying content, logos and feedback promptly. Where we take over an existing website, we'll take reasonable care during any migration and aim to avoid downtime, but we can't guarantee a third party's existing site or data.
8. Support & changes after launch
Your monthly service includes ongoing minor changes and upkeep - the everyday stuff, at no extra cost:
- Text edits, swapping photos, updating prices, opening hours or contact details.
- Small cosmetic tweaks - colours, buttons, moving a section, adding a page of similar content.
- Bug fixes, security patches, software and plugin updates, backups and general maintenance.
Larger work is quoted separately before we start, so there are no surprises. For example: a full redesign or rebrand, new bespoke features (booking systems, calculators, member logins, integrations), adding an online shop, large batches of new pages, copywriting or photography, or ongoing marketing/SEO campaigns. We'll always tell you if something falls outside your monthly service and agree a price first.
Support hours are Monday to Friday, 9am–5pm (excluding bank holidays). We aim to respond to standard requests within 24 working hours. Genuinely urgent issues - such as a site being down - we act on as quickly as we can, usually much sooner. Requests sent outside these hours are picked up the next working day.
9. Hosting & uptime
Your website is hosted on infrastructure provided by our hosting partner, Brixly. Server and infrastructure matters - hardware, network, data-centre and platform-level issues - are handled by Brixly's support team, and our response on those depends on theirs. Some downtime is normal and to be expected: routine security patching, software updates and scheduled maintenance may briefly take a site offline, as is standard for any hosted website. We aim to keep this to a minimum and, where planned, outside peak hours. We do not guarantee uninterrupted or error-free availability.
10. Minimum term, cancellation & ownership
- This is a managed service - we build, host and maintain the site for you. Admin / back-end access to the website is not provided as standard while the service is running.
- You can cancel at any time with 30 days' notice (from your portal or in writing). After the first 12 months the service simply continues rolling monthly on the same basis.
- The £99 setup fee and payments already taken are non-refundable, as work has been carried out.
- If you cancel before completing 12 months: the website, its design, the source files and the included domain remain our property. They are not transferred to you, you are not given admin access or a copy of the build, the site is taken offline at the end of your paid period, and the domain is not released. Your own original content (text, photos and logo you supplied) is always yours and will be returned on request.
- Once you have completed 12 months: the website, its files and the domain are yours to keep. On leaving we'll hand over a copy of the site files and release or transfer the domain to you, and you're free to host it wherever you like.
11. Client-caused issues & remedial work
If a problem with the website is caused by your own actions, or those of someone acting for you - for example editing code or settings, installing plugins or third-party scripts, changing DNS or hosting settings, deleting content, or a security breach resulting from shared or weak passwords - putting it right falls outside your monthly service. Remedial work is charged at £25 per hour, estimated or quoted before we begin wherever possible.
12. Acceptable use
You agree not to use the website or hosting for anything unlawful, or for content that is fraudulent, infringing or harmful. We may suspend a site that puts our systems or other clients at risk.
13. Indemnity
You agree to indemnify us and hold us harmless against any claims, losses, damages, costs or expenses arising from: content you supply or approve; your breach of these terms; your use of the website; any infringement of a third party's rights (including intellectual property) in materials you provide; and any loss or damage caused by your own actions or by third parties acting for you. This does not apply to the extent a claim arises from our own negligence or breach.
14. Liability
We provide the service with reasonable care and skill. We're not liable for indirect or consequential losses, or for loss of profit or business, arising from the website or any downtime. Nothing in these terms limits liability where it would be unlawful to do so. Our total liability is limited to the fees you've paid us in the previous 12 months.
15. Disputes
If something isn't right, tell us first - most issues are sorted quickly with a message on WhatsApp or email. If we can't resolve it between us, both sides agree to try to settle the dispute in good faith before starting court proceedings (for example through mediation). None of this affects your statutory rights.
16. Changes & governing law
We may update these terms from time to time; we'll give notice of material changes. These terms are governed by the law of England and Wales, and subject to the courts of England and Wales.
